Terms & Conditions Sales & Use
ForenShield Client licenses, maintenance, public API and shop: what you buy, what we guarantee, how to withdraw.
Last updated: October 10, 2026
1. Purpose and scope
These terms govern every order placed with ForenShield, trade name of Jérémy Gomes, sole trader (French micro-entrepreneur, Draguignan Trade Register 981 249 402), 362 Avenue Janvier Passero, 06210 Mandelieu-la-Napoule, France (the "Seller"), whether through the client portal, a quote or the shop. Full legal details are in the legal notice.
They apply to consumers and to professionals. Where a clause is reserved for one of them, it says so. Placing an order requires ticking the acceptance box; the version in force on the order date applies, and a copy is sent with the order confirmation. Only the French version is authoritative.
Free online tools, guides and content are governed by the terms of use in the legal notice; the present terms add the rules for paid products and services.
2. Products and services
- ForenShield Client licenses: right to use the ForenShield Client software for 1, 2 or 3 years, paid once, activated through the ForenShield license server.
- Maintenance: yearly subscription giving access to updates and support for the licensed software.
- API plans: daily call quotas on the ForenShield public API, attached to your account and your API keys.
- Shop: merchandise, apparel and computer accessories bearing ForenShield designs, printed and shipped on demand by our fulfilment partner.
Product descriptions, compatibility requirements and visuals are given as accurately as possible; minor differences in colour or finish may occur on printed items.
3. Prices and payment
- Prices are shown in euros. VAT is not applicable (art. 293 B of the French Tax Code): the displayed price is the price you pay, plus any delivery costs shown before payment.
- Payment is made online through Stripe (card and wallets offered at checkout). Your card details are entered on Stripe's secure pages and never reach ForenShield.
- For professionals, a quote issued from the portal is valid for the period stated on it; the order is firm once the quote is accepted and paid.
- Licenses are paid in full at order; maintenance is billed yearly and does not renew without your action.
- An invoice is issued for every order and remains available in your portal.
4. Ordering
Orders are placed from your ForenShield account. Before paying, you review a summary (items, price, delivery costs and time, these terms), then confirm. The contract is formed when the payment is confirmed by Stripe.
You receive an e-mail confirmation with the summary and these terms. ForenShield may refuse or cancel an order in case of payment incident, obvious pricing error or suspected fraud, with a full refund of any amount received.
5. ForenShield Client licenses and maintenance
- Scope: a non-exclusive, non-transferable license granted to the client (natural or legal person) for the duration purchased, for its own internal use. The number of workstations is the one stated on the order.
- Activation: the software checks the license with the ForenShield license server; an internet connection is required at activation and periodically afterwards.
- Prohibited: reselling, renting or lending the license, bypassing the license check, reverse-engineering beyond what the law allows, removing proprietary notices, using the software to attack systems you are not authorized to test.
- Maintenance: while active, you receive updates and e-mail support within business days. When maintenance ends, the software keeps working in its last version until the license expires, without new updates.
- Expiry: at the end of the license term, the software stops working until a new license is purchased. Your local data remains yours.
- Termination for breach: ForenShield may revoke a license used in breach of these terms, after notice left unanswered for 15 days, except in case of serious breach.
6. Public API and API keys
- Keys: created from your portal, attached to your account. You are responsible for keeping them secret and for every call made with them; revoke a key immediately if it leaks.
- Quotas: each plan sets a daily number of calls. Calls above the quota are refused until the next day; quotas are not carried over.
- Fair use: no scraping of the service, no resale of raw access, no use against systems you are not authorized to analyze, no attempt to bypass quotas.
- Availability: the API is provided as is, with no guaranteed uptime. Planned maintenance is announced in the developer documentation when possible.
- Results: analyses are indicative and help your own assessment; they do not replace a professional audit.
- Suspension: ForenShield may suspend a key in case of abuse or security risk, and informs you by e-mail.
7. Shop: production and delivery
- On-demand production: shop items are printed after your order by our fulfilment partner Printify and its print providers, then shipped to the address you gave.
- Delivery time: the estimated production and shipping time is shown before payment. Failing that, delivery takes place within 30 days of the order. If this deadline is missed, you may cancel the order after asking us in writing to deliver within a reasonable additional period, and be refunded within 14 days.
- Delivery area and costs: countries served and delivery costs are shown at checkout. Any customs duties outside the European Union are borne by the recipient.
- Risk: for consumers, risk passes on physical receipt of the parcel. Please report visible damage to the carrier and to us within 3 days.
8. Right of withdrawal (consumers)
As a consumer, you have 14 days to withdraw without giving a reason:
- Physical goods (shop): from the day you or a third party you designate receives the goods. Printed items with ForenShield's standard designs are not "personalized" goods and can be returned. Only items you personalized yourself (text, name, custom size) are excluded.
- Licenses and API plans (digital content and services): from the order. However, if you ask for immediate activation, you expressly agree that performance begins at once and acknowledge losing your right of withdrawal once the license or quota is active. This is confirmed by a checkbox before payment.
To withdraw, e-mail support@forenshield.com with an unambiguous statement, or use the form in section 14. Return the goods within 14 days of your notice, unworn and in their packaging where possible. Return shipping costs are borne by you. We refund all amounts received, including the initial delivery cost, within 14 days of receiving the goods or proof of shipment, using the original payment method. Your liability is limited to depreciation resulting from handling beyond what is needed to establish the nature and functioning of the goods.
9. Legal warranties
Consumers benefit from the legal warranty of conformity (articles L.217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (articles 1641 et seq. of the French Civil Code), independently of any commercial warranty. Professionals benefit from the warranty against hidden defects; the warranty of conformity is limited for them to the replacement or refund of the non-conforming item.
Information required by the French Consumer Code
The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal warranty of conformity in the event of a lack of conformity. During a period of twelve months (twenty-four months for new goods) from delivery, the consumer only has to establish the existence of the lack of conformity and not the date of its appearance.
The legal warranty of conformity requires the professional, where applicable, to provide all the updates necessary to maintain the conformity of goods with digital elements. It gives the consumer the right to repair or replacement of the goods within thirty days of the request, free of charge and without major inconvenience. If the goods are not repaired or replaced, the consumer may obtain a price reduction or termination of the contract, with a refund within fourteen days.
For digital content and services, the consumer has the same rights for two years from supply (continuous supply: for the whole supply period). The consumer also benefits from the warranty against hidden defects under articles 1641 to 1649 of the Civil Code for two years from discovery of the defect, which may lead to a price reduction or termination of the sale.
10. Liability
ForenShield performs its obligations with the care expected of a professional. Analysis results, from the software as from the API, are indicative and depend on the data you submit and on third-party sources; they do not replace an audit nor guarantee the absence of threats.
Towards professionals, ForenShield's liability is limited to direct damages and capped at the amount paid for the order concerned over the last 12 months; indirect damages (loss of data, business, image) are excluded. Nothing in these terms limits the rights consumers hold under mandatory law, nor liability for gross negligence, wilful misconduct or bodily injury.
12. Personal data
Data needed to process orders, payments, deliveries, licenses and API keys is handled as described in our privacy policy (recipients: Stripe, Printify, Supabase; retention: 10 years for accounting records).
13. Mediation and disputes
For any complaint, write first to support@forenshield.com; we reply within 15 days.
Consumers may then use, free of charge, the consumer mediator to which ForenShield adheres. The mediator's name and contact details will be published here before sales to consumers open; no consumer sale takes place until then. The mediator may be contacted within one year of the written complaint.
These terms are governed by French law. For professionals, any dispute falls under the exclusive jurisdiction of the courts of Draguignan. Consumers may bring proceedings before the court of their place of residence or that of the Seller.
14. Model withdrawal form
Complete and return this form only if you wish to withdraw from the contract. Copy it into an e-mail to support@forenshield.com.
